TERMS & CONDITIONS

By entering the ‘Seven Network V8Xtra Vodafone’ competition, you are agreeing to the following terms and conditions:

1. STANDARD TERMS
1.1 Information on how to enter forms part of the terms of entry.

2. WHO CAN ENTER?
2.1 Subject to clause 2.2, entry is open to all residents of Australia over the age of 18 where the Channel Seven signal is received

2.2 Employees and their immediate families of Seven Network (Operations) Limited and affiliates, Vodafone Pty Limited, Yahoo!7 Pty Ltd, m.Net Corporation Ltd and their associated agencies and companies, are not eligible to enter.

3. HOW TO ENTER
3.1 The competition commences on Friday 31 August 2007 at 10:01am (AEST) and concludes on Monday 22 October 2007 at 10:00am (AEST) (“the Competition Period”), however the dates and times for entry are detailed in the table below:

3.2 In order to enter, viewers must watch V8 Xtra (“the Program”) on the Seven Network and its affiliates during the Competition Period. During the promotion period there will be a competition segment aired during the broadcast (or any replacement program broadcast in this timeslot) where viewers will be asked to enter the competition. A competition spot will also be broadcast periodically on the Seven Network, during the promotion period.

3.3 In order to enter the major prize draw, entrants must either:
(a) send a text message to 19 77 8 777 including their full name and state; or
(b) log-on to www.yahoo7.com.au/vodafonev8 to register for the competition. On-line entrants must enter their personal details including their name, street address including postcode, phone number, email address, gender and age range (all fields will be compulsory for entry).

3.4 All entries must be received by 10:00 (AEST) on Monday 22 October 2007. The time of entry will in each case be the time SMS is received by the m.Net Corporation Ltd. database.

3.5 SMS entrants (including the winner) may enter the competition as many times as they like.

3.6 Only one entry per person per day will be accepted from entrants on-line. No scripting is allowed for online entries (which will be deemed invalid).

3.7 For SMS entrants, each entry must be charged to a mobile account and SMS entries via the internet, computer generation or “scripting” are invalid and will not be accepted.

3.8 Maximum entry cost (SMS entry) is $0.55 (including GST). (Note that SMS entry is charged at a premium rate, which covers the cost of entry and reply message.)

3.9 The time of entry will be the time at which the completed online entry form is received by the competition’s online database. Online entrants will be presented with a confirmation page once the completed email entry is submitted by the entrant.

  • The Car prize includes; registration, on road and statutory costs, and dealer delivery.
  • Prize is not redeemable for cash
  • Insurance, additional options and all ancillary costs are the responsibility of the prize winner. 
  • Installation of the Sony Xplod car audio system is not included.
  • If the major prize winner does not hold a current Australian driver’s licence, the major prize will be transferred into the name of an adult or guardian nominated by the winner.

4.3 Total Maximum prize value of major prize is $56,437.90. Total Maximum Prize value of monthly prize is $3,952.00. Total Maximum prize value is $60,389.90. Prize values are the recommended retail prices and are correct as at 16 July 2007. The winners are not entitled to receive any money from any party if there is a difference between the current prize value as at 16 July 2007 and the actual prize value as at the date and time of receiving the prize.

4.4 The Promoter accepts no responsibility for any variation in the value of the prizes.

4.5 Prizes cannot be transferred or exchanged and all non-cash prizes cannot be redeemed for cash. Winners should seek independent financial advice about any tax implications that may arise from the prize winnings.

4.6 In participating in the prize, the winner agrees to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed. The winner agrees to granting the promoter and Vodafone Pty Limited a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winners will not be entitled to any fee for such use.

4.7 The winner agrees they will not sell or otherwise provide their story and/or photographs to any media or other organisation.

4.9 Full details of prizes can be obtained by telephoning the Seven Network in each state on Sydney 02 8777 7777; Melbourne 03 9697 7777; Adelaide 08 8342 7777; Brisbane 07 3369 7777; Perth 08 9344 0777.

5. HOW TO WIN
5.1 At 15:00 (AEST) on the relevant Draw Date (as per the table in clause 3) a draw will be conducted from all entrants who have entered the Competition by either method and correctly registered all details required under clause 3.1 within the competition period (“Monthly Qualifying Entrants”). Two Monthly Qualifying Entrants will be selected at random to win a Monthly Prize.

5.2 At 15.00 (AEST) on Monday 22 October 2007, all entrants who have correctly entered the Competition by either method and registered all details required under clause 3.1 during the Competition (“Qualifying Entrants”) will be entered into the major prize draw. One Qualifying Entrant will be selected at random from the national pool of entrants to win the major prize.

5.3 All draws will take place at m.Net Corporation Ltd, Level 2, 8 Leigh Street Adelaide SA 5000.

5.4 All winners will be notified by a phone call on the day of the draw and will also receive a letter advising them of their prize. The winner’s name will be published in the Public Notes section of The Australian newspaper on Monday 29 October, 2007.

5.5 The promoter’s decision is final and the promoter will not enter into correspondence regarding the result.

5.6 It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.

5.7 It is a condition of accepting the prize that the winners must comply with all the conditions of use of the prize and the prize suppliers’ requirements.

5.8 Subject to any written directions given under regulation 37 of the Lottery and Gaming Regulation 1993 (SA), an unclaimed prize draw will take place at m.Net Corporation Ltd, Level 2, 8 Leigh Street Adelaide SA 5000 on Monday 4 February 2008 at 10:00 (AEST) and the details of the winner will be published in the Public Notes section of The Australian newspaper on Monday 11 February, 2008.

6. NO LIABILITY
6.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under regulation 37 of the Lottery and Gaming Regulation 1993 (SA).

6.2 Seven Network (Operations) Limited & affiliates, Vodafone Pty Limited, Yahoo!7 Pty Ltd, m.Net Corporation Ltd and their associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.

6.3 Seven Network (Operations) Limited & affiliates, Vodafone Pty Limited, Yahoo!7 Pty Ltd, m.Net Corporation Ltd and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:
a) during the draw;
b) whilst undertaking any travel won on or connected with their entry into the draw; or
c) in the participation in any prize;
d) as a consequence of late, lost or misdirected mail;
e) due to the broadcast of any program relating to the competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person;
f) in relation to failure of an SMS entry message to be received by the promoter on account of technical problems or traffic congestion;
g) arising from or related to any problem or technical malfunction of any telephone network or lines or mobile communications network related to or resulting from participation in this promotion.

6.4 Seven Network (Operations) Limited assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries, and reserves the right to take any action that may be available

6.5 If for any reason this competition is not capable of running as planned, due to causes including but not limited to tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition

7. PROMOTER’S DETAILS
7.1 The Promoter is Seven Network (Operations) Limited (ABN 65 052 845 262) of 38 – 42 Pirrama Road, Pyrmont NSW 2009.

7.2 Entry details remain the property of the Promoter. m.Net Corporation Ltd and Yahoo!7, on behalf of Seven Network Limited (ABN 65 052 845 262) and its related entities (“Seven”), is collecting the entrant's - personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winners and awarding the prize). Unless the entrant has ticked the opt-out box, Vodafone Pty Limited may use personal information entrants provide to send information about Vodafone products and services (including via electronic means), and may disclose the information to Vodafone, to its related bodies corporate, agencies and contractors (including call centres, advertising agencies and direct mail houses) that Vodafone Pty Limited engages for that purpose.
